The Supreme Court judgment is a model of clarity, based on the principle that protecting women and girls from discrimination and harassment requires recognising sex as an unchangeable biological reality.
But employers, politicians, officials, activists and even some judges are trying to reject or work around the law. So the fight to uphold it continues.
In 2026, Sandie Peggie and Maria Kelly will appeal against their employment-tribunal judgments, which contradicted the Supreme Court’s clarity. The Darlington Nurses will also receive judgment in their case.
We will continue to support claimants personally and make sure their stories and the legal arguments reach the widest possible audience. We will also pursue our own cases seeking to translate the Supreme Court judgment into clear, simple policies.
And we will continue to engage with the government, employers, sports governing bodies, charities, regulators and public bodies, and to provide resources to help organisations write policies that are lawful and individuals to challenge policies that aren’t.
